Terms of Business

DoHire Ltd (CRN: 10376597) whose registered office is at Bolton Arena, Arena Approach, Horwich, Bolton BL6 6LB is a business and website which, amongst other things, compares the price of tools/equipment and services for DIY purposes and/or trade use.

We provide a price comparison service where you propose to enter into a separate agreement with a supplier for the purchase or hire of tools/equipment or services.

1. General

1.1 These Terms of Business apply to your use of this website.

1.2 By using this website you agree to these Terms of Business. If you do not wish to be bound by these Terms of Business you should not use this website.

1.3 We may change these Terms of Business from time to time. We will give you notice of any changes by posting any such changes on our website. We will not vary any terms which you previously agreed with whilst using this website. However, any amended Terms of Business will apply to your use of this website from the date they are posted and if you do not agree with the amended Terms of Business, you are entitled to stop using this website at that time.

2. Definitions

2.1 "you" and "your" means the person who proposes to use or is using this website.

2.2 "we" "us" and "our" means DoHire Ltd (CRN:10376597) whose registered office is at Bolton Arena, Arena Approach, Horwich, Bolton, BL6 6LB, and our agents and any other person or business to whom we may legally transfer our rights under these Terms of Business.

2.3 "website" means a site on the World Wide Web located at www.dohire.com

2.4 "supplier" means the supplier, distributor or provider of any tools/ equipment or service advertised on this website or made available through this website or who provide a quote to you based on the enquiry you have made to our website.

2.5 "quote" means a price provided by a supplier for comparison with other quotes on the basis of the information you have provided.

3. Use of this website

3.1 By using this website you agree that:

3.1.1 You will not do anything that affects the integrity or security of this website or causes or may cause harm, damage or unreasonable inconvenience to other users of this website or us; and

3.1.2 You will not gather, extract, download, reproduce and/or display or advertise on any other website, other online or off-line service or otherwise, any material on or from this website, whether that information has been gained by the use of spiders, data mining, trawling or other 'screen scraping' software or system used to extract data.

3.2 If you breach any of the clauses set out at 3.1 above, we may take such action as we deem appropriate, including denying you access to this website, bringing legal proceedings against you and disclosing such information to appropriate legal and/or regulatory bodies.

4. UK residents

This website is directed only at UK residents and nothing within it or these Terms of Business constitutes an offer or promotion of tools/equipment or services to persons outside the United Kingdom. We do not make any warranty or representation that the service we offer is available or appropriate for use by those outside the UK.

5. Your obligations

5.1 You must only use the website for your personal use or, if a business user, for legitimate business price comparison purposes.

5.2 It is your responsibility to ensure that all information you supply to us or enter onto this website is complete and accurate.

5.3 You will need to answer a number of questions in order to compare or obtain a quote for any tool/equipment or service. These questions are designed to ensure that we and all relevant suppliers have all of the information necessary to provide you with accurate, appropriate and timely information relating to the tools/equipment or services in which you are interested.

5.4 If you are purchasing and/or hiring tools/equipment or services from a supplier you should read their terms of business. Their terms of business will cover any transaction or agreement between you and the supplier, whereas these Terms of Business agreed with us relate only to your use of this website.

5.5 You should not share any of your personal data with any supplier directly or transact with any supplier directly other than through our website.

6. Our service

6.1 We provide a service which enables you to obtain and compare a number of prices for the purchase and/or hire of tools/equipment or services and make a decision based on those comparisons. We will not charge you a fee for this Service.

6.2 The information you give us is used by the suppliers to formulate their quote. We seek to ensure that we accurately pass on the information you have provided to the supplier for the purpose of providing a price comparison.

6.3 These Terms of Business and our correspondence with you will be communicated in the English language.

7. Validity of quote

We do not control the price, length of offers, or special conditions relating to price comparison quotes. These are set by the suppliers. Supplier prices, rates and offer times are updated and amended on a regular basis so our price comparisons are subject to change.

8. Our responsibility for loss or damage suffered by you

8.1 However, we are not responsible for computer viruses or other computer related problems you suffer as a result of using this website, which are beyond our reasonable control.

8.2 We are not responsible for any commentary, opinions, ratings or other postings on this website by third parties.

8.3 Suppliers and third party websites are responsible for failings or errors on their respective websites.

8.4 Whether you are a consumer or business user we do not prevent or exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury resulting from our negligence.

8.5 When you accept a quote and pay the charges we will pass on the relevant payment to the Supplier for the purchase and/or hire of tools/equipment or services from them. However the contract is made between you and the Supplier directly and therefore we shall not be liable for any loss suffered by you as a result of entering into the contract for the purchase and/or hire of tools/equipment or services from the Supplier.

8.6 A pre-authorization is essentially a temporary hold placed by a merchant on a customer's debit or credit card, and reserves funds for a future payment transaction. When the time comes to finalize a payment – for example, the hire of a tool/equipment – the funds on hold can then be “captured”, meaning they are converted to a charge.

For longer term hires over 6 days we will take the hire and deposit as a normal transaction

We will inicaiate the refund for the deposits with 24 hours.

8.7 If you are a business user:

We exclude all implied conditions, warranties, representations or other terms that may apply to our website or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

use of, or inability to use, our website; or

use of or reliance on any content displayed on our website.

In particular, we will not be liable for:

Loss of profits, sales, business, or revenue;

business interruption;

loss of anticipated savings;

loss of business opportunity, goodwill or reputation; or

any indirect or consequential loss or damage.

8.8 If you are a consumer user:

Please note that we only provide our website for domestic and private use. You agree not to use our website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.

9.0 Intellectual property

9.1 All information, data and copyright material contained on this website, including any trade marks (whether officially registered or unregistered), trade names, brands, logos and devices belong to us or to people whom we have given ownership or permission to use such information data and/or copyright material. You must not use such information or copyright material unless you have written permission from us or the owner to do so.

9.2 You may download or copy the content and other downloadable items displayed on this website for personal and/or business use only (i.e. to assist with a purchasing decision), provided that you are not otherwise breaching these Terms of Business.

10. Privacy policy

10.1 We will use your personal information as set out in our privacy policy.

10.2 If you decide to purchase or hire tools/equipment or services from a supplier as a result of a quote you have received from any contracts you enter into will be entered into with that supplier and they will have their own terms of business and each supplier may have a different privacy policy from ours.

11. Third party websites

11.1 This website contains links to websites operated by third parties. The operation and content of those websites are determined by those third parties and will be governed by separate terms of business. We do not accept responsibility or liability for the content of any third party website.

11.2 Links are provided for convenience only and inclusion of any links should not be taken to imply endorsement in any way of the site to which it links.

12. Termination

12.1 We may issue a warning, temporarily suspend, permanently suspend or terminate your right to use this website if you:

12.1.1 Substantially breach any of these Terms of Business; 12.1.2 Infringe or violate or attempt to infringe or violate any rights of any other user(s) of this website and/or third parties in connection with this website; or

12.1.3 If you are using this website to commit or attempt to commit a criminal offence.

13. Jurisdiction

13.1 If any provisions of these Terms of Business are held by a competent authority to be invalid or unenforceable, the remaining provisions of these Terms of Business will not be affected and will remain valid.

13.2 In the event of a dispute in connection with or arising out of these Terms of Business, English law will apply and we both agree to the exclusive jurisdiction of the English Courts.

13.3 These Terms of Business will only apply as between us and you. Unless as otherwise stated in these Terms of Business no other person may benefit or rely upon these Terms of Business.

Please include your name and address, a contact telephone number, your quote number and details of your complaint.

By the end of eight weeks after receipt of your original complaint letter we will send you a final response or a letter explaining why we are still not in a position to issue a final response and advising you of when we expect to be able to do so.

If your complaint is regarding tools/equipment or services that you have purchased or hired as a result of your initial enquiry through this website then you should complain directly to the relevant supplier responsible for supplying the tool/equipment or service about which you wish to complain.

We cannot answer complaints on behalf of a supplier or accept responsibility for any such complaints. We recommend that you visit the website of the supplier and follow their complaints procedure if you wish to make a complaint against them.
